Myths and Facts about The Costs Involved with Internet Radio

A recent decision by the Copyright Royalty Board (CRB) that increases
the royalties owed by Internet webcasters pay to play music by between
300 and 1200% has jeopardized the future of Internet Radio. This
decision will affect millions of Americans who enjoy the unparalleled
radio diversity that is only available on the Internet; and hundreds
of thousands of artists who depend on Net radio to reach new fans, and
thousands of webcasters whose livelihood depends on their ability to
play music for their listeners.

MYTH: Broadcast radio, satellite radio and Internet Radio pay the
same amount of royalties to creators of music, or pay proportionate
relative to the size of their businesses.

FACT: The smallest medium – Internet radio – pays the most royalties;
and under the new CRB royalty scheme the smallest webcasters will pay
the highest relative royalties in amounts shockingly disproportionate
to their revenue.

* Broadcast radio, an industry with $20 billion in annual revenue,
is exempt and pays no performance royalties to record companies or
recording artists.
* Satellite radio, which has approximately $2 billion in annual
revenue pays between 3 and 7% of revenue in sound recording
performance royalties.
* The six largest Internet-only radio services anticipate combined
revenue of only $37.5 million in 2006, but will pay a whopping 47% (or
$17.6 million) in sound recording performance royalties under the new
CRB ruling. In 2008 combined revenues will total only $73.6 million,
but royalties will be 58% or $42.4 million.
* Small Internet radio services are essentially bankrupted by the
CRB ruling, with most anticipating royalty obligations equaling or
exceeding total revenue.

MYTH: Internet Radio isn’t really that big anyway. Most people still
listen to traditional FM radio.

FACT: At some point every day more than 7 million Americans are
listening to Internet radio. Studies by Arbitron and Bridge Ratings
conclude that between 50 and 70 million Americans listen to Internet
radio every month, and about 20 percent of 18-34 year olds listen to
Internet radio every week.

MYTH: If Internet Radio is so big the higher royalty rates should be
affordable.

FACT: Internet radio is a relatively new industry with advertising
models still developing. Some services rely on banner ads; others are
selling traditional audio ads; and still others rely on sponsorships.
The vast majority of Webcasters will not be able to generate enough
advertising revenue to pay their new, higher royalty fees.

MYTH: The webcasters’ previous royalty rate was too low and needed to
be increased to ensure that artists and record companies are paid fairly.

FACT: Bankrupting the Internet radio industry will not benefit
artists or record companies, as total industry royalties will
diminish. Moreover, the demise of Internet radio will be particularly
harmful to independent artists and record labels whose music is rarely
played on broadcast radio. The American Association of Independent
Music reports that less than 10% of terrestrial radio performances are
independent music but more than 37% of non-terrestrial radio is
independent music. This benefits artists, labels and music fans.

When Congress provided webcasters a guaranteed “statutory license” to
perform sound recordings, Congress intended that Internet radio would
flourish as a competitive medium offering diverse programming and
paying a royalty. Tripling webcasters royalties undermines all these
goals.

MYTH: Big webcasters can afford these royalties and they will each
offer hundreds or thousands of channels, so what’s the big deal?

FACT: The CRB royalty is so high that even the biggest Internet-only
radio services – including Yahoo, AOL, MTV and RealNetworks – will pay
a combined 50+ percent of their revenue for only this single royalty.
The only way to make a profitable, scalable business will be to
attract the largest audience and advertisers while reducing overhead
and innovation. The result will be “mass appeal” Internet radio
programming that will look much more like today’s broadcast radio,
rather than the diverse programming that exemplifies today’s Internet
radio.

MYTH: The rate is only increasing from 7/100 of a penny per song
streamed to 19/100 of a penny per song streamed over a 5-year period.

FACT: Nearly tripling the per-song royalty rate is only the first
insult.

* No Revenue-based Royalty Option. Prior to this decision all
small webcasters and some large webcasters had the choice of paying
royalties based on a percentage of their revenue that typically
equaled 10-12%. But the CRB decision did not offer a revenue-based
royalty option for any webcasters.
* Retroactive Impact. The CRB decision is effective as of January
2006, so if it actually becomes effective for only one day its impact
will be immediate as the past due royalties alone will be enough to
bankrupt virtually all small and mid-sized webcasters.
* Per Station Minimum. The CRB piled on even more, by imposing a
$500 per channel minimum royalty that for many services will far
exceed the annual royalties that would otherwise be due even after the
CRB decision. One advantage of Internet radio is that it is not
limited by spectrum capacity or bandwidth capacity, which enables
several services literally to offer 10,000 or 100,000 stations and
more. By penalizing this innovation and creativity the CRB further
ensures that Internet radio will become less creative, less dynamic,
less of an opportunity for non-mainstream artists and genres, and will
look more like broadcast radio in the future.

Internet Radio’s Day of Silence and Why Podcasters Might Not Agree

banner_wherewillube_300×250.gifOn June 26, 2007 a huge coalition of Internet radio stations from Yahoo and Live365 down to small mom and pop organizations will be going silent to protest the recent CRB ruling in the U.S. which hikes fees dramatically for Internet radio stations potentially putting a lot of them out of business. But Podcasting News is wondering out loud if maybe mainstream Net radio deserves to die.

The argument they put forward is best summarized in the quote:

But while SaveNetRadio calls itself a grass-roots coalition, it counts as its members a long string of big media companies - companies like Yahoo!, Live365, Rhapsody and MTV. They’re really not trying to save Net radio, they’re trying to get the government to legislate favorable business conditions so that they can profitably run mainstream Internet radio services.

In other words, they’re trying to make Internet radio safe for Bon Jovi, Billy Joel and Celine Dion.

Essentially they are saying that Net radio is just perpetuating the out-dated business model of the major labels unlike podcasting, where the whole raison d’etre is to discover and promote new music not aligned for the most part with the infamous RIAA.

Since the whole idea of The Rock and Roll Report is to promote great indie and unsigned rock and roll, I certainly have some sympathy with this argument but I still think that Net radio deserves to be saved despite the fact that it will benefit some “big media” companies. There are a number of great Net radio stations like Radio Paradise that do not deserve to be bankrupted off the air. Or look at a show like The Time Machine that is hosted on commercial radio or the innumerable non-commercial and public radio stations like KEXP FM whose great success has been linked to their webcasting over the Net and yet this important avenue is now threatened with extinction. And Live365 has so many cool shows that I cannot possibly list them all and all of them are an incredibly diverse and fantastically eclectic bunch that will be silenced for the most part because of this ruling.

The Rock and Roll Report has never discriminated based on modes of distribution which simply means that if I like what I hear I will play it or write about it regardless of how the music is distributed. That being said, there is too much great music being produced on indie and DIY labels to cause me to spend too much time with the majors but it happens. The nice thing about Rock and Roll Report Radio on CKUT FM, which is a non-commercial community radio station here in Montreal is that I have the freedom to play something from a major mixed in with all my indie stuff if I want to and sometimes it is nice to throw in some obscure track from the Kinks or It’s a Beautiful Day to highlight the influence that they might have on a certain band today or to just point out to my listeners that the sum total of the Kinks for example is not You Really Got Me and Lola. This is something that I will not be able to do on the upcoming podcast.

At the end of the day, the biggest complaint of music fans is the lack of diversity on the radio dial and for this reason they are turning to Net radio and podcasting in droves. While overturning the CRB ruling might make Net radio safe for the likes of Celine Dion and Bon Jovi, it is a necessary sacrifice that must be made to ensure that the small, truly independent webcasters survive. Podcasting and Net radio can thrive and survive side by side. Trying to kill one while promoting the other is a mistake. While it is true that mainstream Net radio perpetuates all that is wrong with the mainstream music industry, I do not think that throwing the baby out with the bathwater is the solution. As more musicians take control of their own destiny and embrace things like podcasting and using YouTube and MySpace to promote their music, the mainstream music industry will slowly fade away as we know it to be replaced by an industry that merely distributes music and doesn’t control it. I support the Day of Silence despite the fact that I abhor the RIAA and their mafia-like tactics. I have listened to too much good Net radio in the last few years to see this vibrant media go silent for good.

Rock and Roll Report Radio Playlist for June 18, 2007

joeyreynolds-small.jpgWell I conducted the six month rock and roll review last night on Rock and Roll Report Radio and played a selection of songs that I have featured since January. You know, it is very difficult for me to do a show like this because all of the songs I play on Rock and Roll Report Radio are played because I like them. There is no pressure from the station, or advertisers or record labels for me to play my stuff. I play what I like, always have, always will.

As I go through my playlist I once again shake my head at how so much great music can fall through the cracks in this day and age. Luckily, the advent of sites like MySpace, Pandora and Last.FM make it easier to find new music and certainly The Rock and Roll Report is just a tiny spot on the music blogosphere but it is astonishing that commercial mainstream rock radio does not give this stuff any significant airplay. Based on the feedback that I have been getting, the reaction to the bands and artists featured on The Rock and Roll Report and Rock and Roll Report Radio would slot in quite well in any truly forward thinking, hip rock radio station playlist that actually cares about the music. There are still some around but their numbers, like independent record stores, are unfortunately dwindling away before our eyes.

Anyhow, this is what I played last night. Visit the various band websites, listen to some of their tracks and if you like what you hear, buy their CD (if the album title is clickable on my playlist you can buy it directly through The Rock and Roll Report and support both the band in question and this very website!) or go to one of their shows. It’s what puts the butter on their bread and what encourages them to keep rocking. Blaring rock and roll in the summertime, can there be anything better?

That Vision Thing: A Look at the Mission of the Upcoming Rock and Roll Report Podcast and Why I Have No Time for the RIAA

chic-with-attitude.bmpAs I turn my sights away from the Rock and Roll Report site re-design (the heavy lifting has been done, the rest is merely fine tuning, right Graham?) and towards the upcoming Rock and Roll Report podcast I thought it appropriate to let you know a little bit about my vision for it and why I hope you will get involved.

There is currently a huge outcry amongst webcasters in the United States due to the recent Copyright Royalty Board ruling that essentially puts such an onerous burden on webcasters that it will in effect drive them out of business (see SaveNetRadio.Org for all the grim details). What most webcasters found infuriating in the extreme is that, far from promoting and encouraging Internet radio as the great promotional tool that it is because it is put together for the most part by passionate fans of the music that they are webcasting, organizations like the RIAA and Soundexchange are doing their best to snuff out this growing industry because it presents such a danger to the established ways that the majors have done business since the dawn of the vinyl record.

I am not one to slam the major record labels for the sake of fun (OK maybe a little bit) and I in fact listen and support a number of bands on these labels, everybody from The Tragically Hip, U2, Jet and Oasis to brand new Island Def Jam signing The 88. But it becomes clearer to me with every passing day as I am flooded with an amazing amount of CDs and MP3s that the major labels are no longer interested in digging up new, exciting talent and instead are more than content to cater to the lowest common musical denominator to give them the biggest bang for their corporate buck. I understand this but don’t use your mis-guided dinosaur business tactics and political pull to kill something that actually does something that you do not: nurtures new talent with a motive that looks beyond the bottom line and instead understands that, while music can be a business and money is a necessity to do what we do, we understand that music has always been about more than money. Music is a creative endeavor, one that is performed by artists not because they want to make tons of money (although there are plenty of musicians who have sacrificed artistic integrity for a pure profit motive but that is another story) but because they have a need to create. The difference is that now the artist has it within their grasp to make a living through a number of different avenues other than giving up all of their rights to their creations in order to suck on the corporate teat.

Podcasting is just one such avenue. I think I have demonstrated with Rock and Roll Report Radio that my mission is simply to play and promote rock and roll that I consider to be criminally under-played from artists toiling away on innumerable indie and DIY record labels which are in business because they are passionate about music. Go figure! The Rock and Roll Report podcast is just one outlet that they can use to promote their rock and roll vision to fans eager to be a part of the dream, and far from stealing their music, those fans will support these bands with their hard earned money because they want to, not because they are told to. That is why artists are creating “podsafe” music because they know that real music fans, if they like it will support them and not rip them off. Their podsafe songs are an investment in the best sense of the term. They give out in the spirit of sharing and are rewarded with a more direct relationship with their fans, a relationship not dictated or hindered by corporate politics and machinations.

The Rock and Roll Report podcast will build on Rock and Roll Report Radio but will be much more interactive and adventurous. Produced once a week, the approximately 20 minute show will feature anything from a specific label or band focus, theme shows, interviews, live events and just random rock and roll with insightful observations on life (ok that last comment is a bit of a stretch!). Show notes will be posted to The Rock and Roll Report with information on the artists played and where possible, direct links to purchase their CDs. A companion video podcast is in the discussion stage and hopefully we will be doing some live showcases which will be fodder for even more “special event” podcasts.

At the end of the day, The Rock and Roll Report is about treating those musicians we cover with the respect we feel that they deserve. We are passionate about our rock and roll and we want music fans to have a listen to what we think will float their rock and roll boat. We are giving artists and labels the opportunity to get the good word out and we hope that you will want to get involved because after all we are not the ones making the music, we are just the ones shouting about it from every rooftop that we can find. radio-mic.jpgWell another Rock and Roll Report Radio on the Drastic Plastic Program on CKUT FM has come and gone. I must apologize for running out of time and therefore not back-announcing the last 4 songs played but such is the risks I run when I try to cram in as much music as possible in 60 minutes. This is one of the reasons why the upcoming Rock and Roll Report podcast will be such a great outlet as I will be able to feature much more music once a week, every week than is possible now on the monthly Rock and Roll Report Radio.

Once again I tried to emphasize the “niche-free” nature of The Rock and Roll Report by roaming all over the musical map. From the metal stylings of Accomplice to the more modern, indie rock style of The Tender Box to the glam of Atomic Swindlers and the “kick-ass, down and dirty” Bamboo Kids, I try to demonstrate to you how much great DIY and indie rock and roll that there is out there. I am consistently amazed that none of this stuff is able to find a home on commercial rock radio. Because of that, The Rock and Roll Report will always be promoting and playing this stuff every chance we get to prove to you and ourselves that rock and roll is not only alive and well but kicking, screaming and vibrating across the sonic landscape with as much immediacy and impact as it ever had. As a side note, in addition to the audio podcast we have a video podcast in the pipeline as well as some plans for a “Rock and Roll Report Presents” style live showcase so you will hopefully be able to experience live what I play on the radio.

radio.JPGWell another edition of Rock and Roll Report Radio on the Drastic Plastic Program has come and gone and nobody was killed or maimed in the excercise (that I know of!). I suppose now is as good a time as any to reiterate what the show and this very website/blog are trying to do.

There are a ton of bands and artists out there playing rock and roll for the sheer passion of it. They are on small indie and DIY labels with meager publicity budgets that almost always fall under the regal gaze of commercial rock radio’s programming overlords. Yet, when you listen to this stuff, you quickly realize how good it really is. You like the Stones? Have a helping of the Blessings or the Sleepers. Pearl Jam more your thing? Check out the Dead City Riots. A bit of glam for your breakfast? The Atomic Swindlers fit the bill perfectly. I could go on but you get my point. The quality is there, the energy is abundant but most of all, the music shines because of their passion. It is almost criminal that these musicians do not get their fair shake and so this is why I continue to write the Rock and Roll Report and produce Rock and Roll Report Radio (with a baby podcast on the way!). All of the songs that I play on Rock and Roll Report Radio would slot in no problem into a commercial rock radio playlist. People want to get their kicks with rock and roll but they are sick and tired of hearing the same tracks from the same artists played with the same dreary monotony. Hopefully, the Rock and Roll Report will give you one of many places to go to help you discover some truly great rock and roll. It is not intended to be THE destination but merely a signpost along the way on your musical journey. There is more than enough rock and roll to satisfy all of us, we just have to dig a little to find it. And when we do, man are the rewards worth it.
